1. Acceptance of Terms

By accessing or using WorkGPS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of the Service immediately.

2. Description of Service

WorkGPS is a job search and career management platform. It provides job listings aggregated from third-party sources, AI-assisted resume tools, application tracking, and other career resources. The Service is intended for personal, non-commercial use.

3. User Accounts

You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date.

4. Subscription and Billing

WorkGPS offers a Pro subscription at $5.00 per month. Subscriptions are billed monthly through Stripe. You may cancel at any time; your access continues until the end of the current billing period. Refunds are not provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to: (a) use the Service for unlawful purposes; (b) attempt to reverse-engineer or scrape the platform; (c) share your account credentials; (d) upload harmful or offensive content.

6. Intellectual Property

All content, trademarks, and software on WorkGPS are the property of WorkGPS or its licensors. You may not reproduce or distribute any part of the Service without written permission.

7. Third-Party Services

WorkGPS integrates with third-party services including job data providers and AI APIs. We are not responsible for the accuracy, completeness, or availability of third-party content.

8. Disclaimer of Warranties & AI Disclaimer

The Service is provided "as is" without warranty of any kind. We do not guarantee job placement or employment outcomes.

Important AI Disclaimer:

WorkGPS utilizes artificial intelligence (including Google Gemini API) to generate suggestions, resume reviews, outreach emails, and other career materials. AI-generated outputs may contain inaccuracies, errors, omissions, or biased statements. You are solely responsible for reviewing, verifying, and editing any AI-generated content before sending, publishing, or relying upon it. WorkGPS is not liable for any consequences resulting from your use of AI-generated content.

9. Dispute Resolution & Binding Arbitration

Please read this section carefully, as it affects your legal rights, including your right to file a lawsuit in court.

Initial Dispute Resolution: Most concerns can be resolved quickly by contacting us via the Feedback tab in the app. The parties agree to use their best efforts to settle any dispute directly through consultation and good faith negotiations before initiating arbitration.

Binding Arbitration: If the parties do not reach an agreed-upon solution within 30 days of informal negotiation, then any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

Class Action Waiver: The parties further agree that any arbitration shall be conducted in their individual capacities only and not as a class action or other representative action. You and WorkGPS expressly waive the right to file a class action or seek relief on a class basis.

10. Governing Law

These Terms and the relationship between you and WorkGPS shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

11. Limitation of Liability

To the maximum extent permitted by law, WorkGPS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

12. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time from the profile settings.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
